Litigation Procedure – Case Suspension – Criminal Case – Employment Case – Unpaid Dues – Dismissal
The original dispute involved unpaid dues following the dismissal of an employee. The employer asked for the case to be suspended until a criminal case was decided on. The court wrongly agreed to do this as the criminal and employment case had not connection.
Background
An employee filed a case against a company and requested the court to order the company to pay him 1.041.908 AED and 12% annual interest. The employee stated that he had started working with the company on 04/08/1969 and was dismissed from his job on August 1999. The employee stated the company should refused to pay his dues.
The company requested the court to suspend the case until a penal case was settled.
The court ruled that the case should be suspended until the penal case was settled.
The employee appealed the ruling before the court of appeal. The court rejected the appeal and upheld the appealed ruling.
