Litigation Procedure – Appeal – Notification – Termination of Employment – Resignation – Unpaid Salary
The original dispute involved an employee who had resigned after their salary had not been paid. The key issue was the litigation procedures. The employee tried to argue the proceedings should have been cancelled as he had not been correctly notified of the appeal. However, as both parties had attended the session the dispute still existed.
Background
An employee filed a case against a company and requested the court order the company to pay him 187000 AED and annual interest. The employee stated he had started working with the company on 01/03/1999 and had later resigned because the company had refused to pay his salary.
The court ruled that the company should pay the employee 1285000 AED and 9% annual interest plus the value of a flight ticket.
The company appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case.
