DCC 107/2001

The original dispute involved a company which wanted the court to rule it no longer owed an employee any money. The employee had filed a case against them after receiving their dues. The court was wrong to request the employee to swear an oath. The court should not request a party to swear an oath which contradicts the general order.

Background

A company filed a case against an employee and requested the court to rule that it no longer owed 11.966 AED to them. The company stated that the employee had received all their dues but had then filed a case against the company.

The court rejected the case.

The company appealed the ruling before the court of appeal. The court requested the employee to swear before the judge but the employee did not attend the session. The court abandoned the appealed ruling and ruled that the company no longer owed the employee the amount.
