DCC 89/2001

This case involved an employee who had not been paid their dues after a date despite having continued working. He had provided the court with a document signed by a captain with his name and other employees' names which proved he had been working on a ship. The court had wrongly ignored this.

Background

An employee filed a case against two defendants and requested the court order them to pay him $43011.5 and 9% annual interest. The employee stated he had a ruling that obliged the defendant to pay his dues until 19/11/1998. The employee stated had continued working after that date but the defendants had refused to pay his dues.

The court rejected the case.

The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.
