DCC 66/2001

This case involved a claim for unpaid salary by an employee who had not been paid salary and had had to resign. The court stated it did not have a mandate to hear the case because it was a collective dispute. The dispute was an individual one that fell under the mandate of the civil courts.

Background

An employee filed a case against a company and requested the court order the company to pay him 17600 AED and annual interest plus the value of a flight ticket. The employee stated the company had refused to pay his salary since November 1999 so he had resigned.

The court ruled that the company should pay the employee 10677 AED and the value of a flight ticket plus annual interest of 9%.

The company appealed the ruling before the court of appeal. The court abandoned the appealed ruling and stated the court had no mandate to consider the case.
