Employee –Dismissal –Dues –Severance pay –Notice
In this case an employee claimed he had been dismissed from his job but had not received his dues. A key issue was whether he deserved severance pay. The employer correctly argued the employee did not deserve this as they had left the position without giving notice.
Background
An employee filed a case against a company and its owner and requested the court order them to pay him 105.675 AED and annual interest of 9%. The employee stated he had started working with the company on 01/01/1977 and was dismissed from his job on 29/11/1999. The employee stated the company had refused to pay his dues.
The court ruled the company's owner should pay the employee 78905 AED and annual interest of 9%.
The company's owner appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the owner should pay the employee 77101 AED and annual interest of 9%.
