DCC 104/2001

This case involved a claim for unfair dismissal. The employer tried to argue the employee had not provided sufficient evidence of the damage they had suffered as a result of the dismissal. This was rejected as the employee had not been paid their salary and this meant the dismissal was unfair.

Background

An employee filed a case against a company and its owner and requested the court order them to pay him 200492 AED and annual interest. The employee stated he had started working with the company on 01/01/1990 and was unfairly dismissed on 18/06/2000. The employee stated that the company had refused to pay his dues.

The court ruled that the company and its owner should pay the employee 180080 AED and 9% annual interest.

The company and the owner appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the company and the owner should pay the employee 64174 AED and the value of a flight ticket.
