DCC 71/2000

This case involved a claim by an employee who had been dismissed for his dues. The key issue in this case was that the court not let the employer prove the contract of employment was a simulated one and the employee actually worked for another business. This was a valid argument as the court had ignored the employer's defence.

Background

An employee filed a case against an employer and requested the court to order the employer to pay him 67682 AED and annual interest. The employee stated he had started work on 26/10/1996 and was dismissed on 01/12/1998. The employee stated the employer had refused to pay his dues.

The court ruled that employer should pay the employee 52492 AED and 9% annual interest.

The employee and the company appealed the ruling before the court of appeal. The court rejected the two appeals and upheld the appealed ruling.
