DCC 42/2000

This case involved a claim for compensation for unfair dismissal after an employee was accused of a crime but found innocent but the company refused to reinstate them. The key issue was the calculation of the compensation. The legislation detailed a maximum amount but the court had the authority to reduce this.

Background

An employee filed a case against a company and its owner and requested the court order them to pay him 76075 AED. The employee stated he had started working with the company on 01/06/1997. The employee stated he was accused by the company of mismanagement and referred to the criminal courts but the court had found him innocent. The employee stated that the company had refused to reinstate him.

The court ruled the company owner should pay the employee 2000 AED and the value of a flight ticket.

The employee appealed the ruling before the court of appeal. The court changed the ruling and ruled the owner should pay the employee 10800 AED.
