DCC 23/2000

This case involved a claim by an employee who had been unfairly dismissed for his dues. The company tried to argue the dismissal was fair as the employee had leaked company secrets. The court rejected this as they had the authority to assess whether a dismissal was unfair.

Background

An employee filed a case against a company and requested the court to order the company to pay him 377.375 AED and annual interest. The employee stated he had started working with the company on 15/03/1993 and was dismissed from his job on 10/12/1998. The employee stated the company had refused to pay his dues.

The court ruled that the company should pay the employee 203.767 AED and annual interest of 9%.

The employee and the company appealed the ruling before the court of appeal. The court changed the ruling and ruled that the company should pay the employee 235.067 AED and annual interest of 9%.
