Agency agreement – Termination – Cause – Minimum purchase clause
The original dispute was the request to cancel a registered agency agreement. A range of issues were covered including whether it was the court or the ministry which had jurisdiction. A key issue was that the agent had not complied with the agency agreement as it had failed to purchase a minimum of 600,000 Swiss Francs in goods per year and this was a clear clause in the agreement. It was confirmed the relationship was one of agent and principal not buyer and seller.
