The original dispute involved a request to make a share purchase agreement null and void after it had been discovered that the company whose shares were being purchased did not own the land on which its factory was built and its machinery was faulty. A key issue in this case was whether it should be referred to arbitration. An arbitration agreement had been signed by the lawyer who had been given a power of attorney on the share purchase but had not it was stated also been given authority to agree to an arbitration agreement.
