The original dispute involved a claim for the amount payable from a life insurance policy by a wife of a deceased man. The insurance company had claimed the policy had been invalidated as the deceased had not informed them of health problems and family history. It was stated under the law of evidence the defendant had failed to prove their arguments. The deceased had died three years after the policy had been taken out was not under a duty to inform the insurer of increased risk.
