Trademark – Infringement – Attachment Orders
The original dispute involved a claim against two companies for infringing another's trademark. The key question in this case was whether the fact there had been decisions on attachment orders it was considered a decision had already been made in this case by the Court of Cassation and the issue could not be considered again. It was declared the decisions on attachment orders were not res judicata with the main claim.
Background
A claim was brought against two companies for infringing the claimant's trademark. The Court of First instance court held the trademark had been infringed, but rejected the claimant's other claims. Both parties appealed. The appeal court rejected both claims. The defendants appealed by cassation arguing that the judgement had contradicted a cassation court decision on an attachment order.
