The original dispute involved a car which had been purchased but then needed repairs. While being repaired it was damaged and the owner decided to claim compensation and transport costs after he decided to leave the car with the dealer. The claim was against the car dealer and the insurance company. The initial damage was not caused by a manufacturing fault but damage carried out by the dealer's mechanic was their responsibility and a fair amount of compensation had been ruled by the court of appeal. The claimant had decided to leave the car with the dealer so could not claim for transport costs. The insurance company was not liable for indirect losses or losses caused by the mechanic.
