DCC 12/1996

This case involved a claim brought by subrogation by an insurer who had compensated an insured party for damaged goods transported by sea. Under the Maritime Code there was a time bar which applied to such claims. The insurer tried to claim they deserved an extension as they had been waiting for their insured's claim to complete. This argument was dismissed as they could have joined the Carrier, or filed a counterclaim requesting an indemnity in the event judgement was delivered against them.
