DCC 288/94

This case involved a claim for compensation for damage which had been done to a vehicle by a crane. The crane driver was one of the parties and after a criminal case against him was dismissed, this civil case had also been dismissed. It was argued the company which owned the crane and the insurance company should still have a civil liability to compensate for the loss of the vehicle. As none of the parties had been aware of the presence of the pipeline which the crane had struck and had caused the accident compensation could not be claimed from these parties.
