DCC 99/1994

This case involved a claim for damages for goods which had been damaged on a vessel. The key question was whether the claim was time barred. It was argued that sharia law prevented a time bar and that the time bar period had not been correctly calculated under the civil procedure code. Sharia law did not apply as the claimant had no excuse for failing to assert the claim in the prescribed period. The civil procedure code also did not apply as this case was covered by the maritime code.
