Background
A claim was brought against a defendant for failing to pay for goods delivered to them. The first instance court ordered the defendant to pay the amount claimed and the defendant appealed. The appeal court upheld the judgement and the defendant appealed by cassation arguing one of the judges had failed to sign the original copy of the judgment.
Decision
The court stated that the judge had signed the handwritten copy of the judgement, which was proof he took part in the proceedings with the other judges. His failure to sign the final original document did not therefore invalidate the judgement. The appeal court's judgement was therefore upheld.
