BCC 403/2023
This case involved compensation for a delay in construction work. A key point was the expert could not make a decision on compensation for a delay.
Background
A claimant filed a case against defendants before the court. He requested the court to order the defendants to pay him an amount of money. He said that the second defendant had agreed to build a villa for him in exchange for an amount of money. He said that the two parties agreed the delivery of the project would be within eleven months. He said that the defendant had failed to commit to his obligation and that the project was not delivered on time. He said that the second defendant owned a contracting company (first defendant).
The court dismissed the case against the third defendant. The court ruled that the second defendant should pay the claimant the amount of money estimated by the expert.
The first and second defendants appealed the ruling before the court of appeal. The court upheld the appealed ruling.
