The initial dispute involved an employee whose employment was terminated but had not been paid her entitlements. A key point was whether the employing company had been properly notified of the case.

Background

An employee filed a case against a company before the Labor Lawsuit Office to claim her labor entitlements. She said that she had worked for the company starting on 8 December 2021, with a monthly salary of 200 dinars. On 25 August2022, the company notified her of the termination of her employment relationship, and her last working day was 31 August 2022. She said that the company failed to pay her entitlements.

The case was referred to the relevant court.

The court ruled that the company should pay the employee her entitlements.

The court of appeal upheld the ruling.

The company appealed the ruling before the court of cassation. The company said in their grounds of appeal that the ruling had erred in the application of law. The company said that they were not informed of the case and therefore were unable to defend their case.
