This case involved an objection made to the division of some land. A key issue was whether the claimant had capacity as they stated there should have been a consultation with the department of urban planning because of the impact on road safety.
Background
A claimant made an objection to a ruling issued by the court of appeal. He requested the court to dismiss the ruling and dismissed the case. He said that the ruling which divided land belong to the defendants was illegal and caused him damage.
The court dismissed the objection.
The claimant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. He said that the court had established the ruling on the grounds that he did not have an interest in the objection though the division of land without consultation of the department of urban planning would affect the safety of public roads.
