BCC 744/2019
This case involved a failure to pay for completed contracting work. The court had been wrong to require payment as the expert had confirmed the work had not been carried out to the agreed standards.
Background
A company filed a case against a defendant before the court. The company requested the court to order the defendant to pay 7030 Dinars. The company said that they had finished contracting work for the defendant and he had failed to pay the remaining contracted amount.
The court ruled that the defendant should pay the company 5500 Dinars and interest.
The disputed parties appealed the ruling before the court of appeal. The court dismissed the appeals and upheld the appealed ruling.
The defendant appealed the ruling before the court of cassation. The defendant said in his grounds of appeal that the ruling had insufficient evidence of causation. He said that the court had ordered him to pay the amount though the expert had concluded that the company had not finished the work according to the agreed standards.
