This case involved non-payment of an instalment of a loan used to purchase a car. A key point was whether a contract term which stated in case of default of one instalment all instalments should be paid could be ignored by the court.
Background
A company filed a case against a defendant before the court. The company requested the court to order the defendant to pay 7989 Dinars and interest of 10%. The company said that the defendant had bought a car with a loan but he had failed to pay the full value of the instalments.
The court ruled that the employee should pay the company 1211.8 Dinars.
The company appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the defendant should pay the company 1340.4 Dinars.
