The initial dispute involved non-payment of a loan by a bank customer and the reservation of their account. Key issues included whether he should be considered to have appealed or it should have been considered a plea.

Background

A bank filed a case against a client before the court. The bank requested the court to urgently reserve a client’s accounts and pay an amount of money plus interest. The bank said that the clients had received a loan but he had failed to pay the installments.

The court ruled that the client should pay the bank 11515 Dinars in addition to interest of 1%. The court also ruled that the client’s accounts of a value of 11515 Dinars should be reserved.

The client appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The client appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had insufficient evidence of causation. He said that the court considered his appeal as one against the ruling issued after his plea although his appeal was filed against the ruling issued by the court of appeal.
