This case involved a contra agreement where payments were to be made for a marketing campaign and the company's CEO had agreed to pay work for maintenance of housing units he owned. A key point was the company which had assigned the work on the housing units was independent of the other company.

Background

A marketing company filed a case against another company before the court. The company requested the court to appoint an expert in order to consider a dispute between the two parties and calculate their entitlements. The company said that the other company had agreed to pay 10% of the fees that they would receive from a third party in exchange for a marketing campaign but they had failed to commit to their obligations.

The other company filed a case against the marketing company and its CEO before the court. Th company requested the court to order them to pay 195607 Dinars for maintenance work done on housing units owned by the CEO.

The court dismissed the two cases.

The two companies appealed the ruling before the court of appeal. The court upheld the appealed ruling.
