Background

The employee and the hospital appealed the ruling before the court of cassation.

Decision

Appeal No. 276/2020:

The hospital said in its grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. The hospital said that the court had ordered them to pay compensation though the working relationship between the two parties had ended as the employee did not hold a licence to work as doctor.

The court said that this argument was valid. The court said that the case documents revealed that the employee had failed to receive the required licence to work as a doctor.

The court repealed the appealed ruling.
