This case involved whether a case involving defective goods which had been purchased fell outside the statute of limitiations.

Background

A claimant filed a case against a company before the court. They requested the court to order the company to pay them 64140 Dinars and 9% interest. They stated that they had bought porcelain tiles from the company. However, when they installed the tiles, they discovered that they did not match with the agreed standards.

The court ruled that the company should pay the claimant 12489 Dinars.

The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The company appealed the ruling before the court of cassation. The company said in its grounds of appeal that the ruling had erred in the application of law. The company said that the case should have been dismissed due to the statute of limitation under Article 111 of Bahrain Decree-Law No. 7/1987 e.
