BCC 1495/2019

This case involved a breach of a consulting services agreement. A key issue was whether the photocopy of the agreement had been forged.

Background

Two claimants filed a case against a defendant before the court. They requested the court to order the defendant to pay them 250000 Saudi Riyals. They said that the defendant had agreed to provide them consulting services but he had failed to commit to his obligations according to the contract.

The court dismissed the case.

The claimants appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The claimants appealed the ruling before the court of cassation. They said in their grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. They said that the court had established the ruling based on the defendant’s denial of the photocopy of the documents in which the defendant had admitted that he had received the amount from the claimants. They said that they had provided the court with the original document and requested the court to investigate the authenticity of the defendant’s signature.
