BCC 144/2020

This case involved the same of land in Egypt. A key question was whether the Bahraini courts had jurisdiction. Although the land was in Egypt and one of the parties lived outside Bahrain. The parties were Bahrainis and the contract had been concluded in Bahrain.

Background

A claimant filed a case against a company and other defendants before the court. She requested the court to order the defendants to pay them 3700 Dinars and interest of 10% in addition to compensation. They said they had agreed with the first defendant to buy two pieces of land in Egypt and paid the value in advance. They said that the defendants had failed to commit to their obligations. The claimant had later decided to dismiss their case against the company.

The court ruled that the first defendant should pay the claimant 2500 Dinars.

The first defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
