BCC 1362/2019
This case involved an individual who had failed to pay management fees for villas in a resort. A key issue was whether they had been notified in the correct way.
Background
A company requested a judge to order a defendant to pay 3196.5 Dinars and interest. The company said that the defendant was an owner of two villas in a resort which the company managed. The company said that the defendant had failed to pay the management fees.
The judge refused to issue the order and the case was referred to the court.
The court dismissed the case because it was not filed by a relevant party.
The company appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the defendant should pay the amount to the company.
The defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling was invalid because he was not informed by the appeal at his address.
