This case involved a request by an ex husband that his ex wife should vacate their marital home which the court had ordered should be divided between them because he had a new house for her and their children. The court had been wrong to order this as an expert had stated the property was unsuitable.
Background
A claimant filed a case against his ex-wife before the court. He requested the court to order the ex-wife to vacate a disputed property. He said that a previous ruling had ordered him to divide his house between him and ex-wife. He said he had married a new wife and that he had provided a different house for his ex-wife.
The court dismissed the case.
The claimant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the ex-wife and her sons should move to the new house.
