BCC 49/2019

This case involved the breach of an agreement to construct a property. A key issue was whether the evidence was a forged photocopy. An expert concluded it was not forged.

Background

A company filed a case against a defendant before the court. The company requested the court to order the defendant to pay an amount of money and interest of 13%. The company said that they had agreed to build a model home as part of a housing project agreed with the defendant. The company said that the defendant had failed to commit to his obligations according to the signed contract.

The court ruled that the defendant should pay the company the amount and interest of 2%.

The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
