The original dispute involved an employee who claimed they had been dismissed from their job without legal justification and not paid all their financial entitlements. A key issue was whether the employer had been properly notified of the court proceedings.
Background
An employee requested the office of the labour disputes settlement to order a company to pay his financial entitlements. He said that he had been working for the company and that he was dismissed from his job without legal justification. The case was referred to the court.
The court ruled that the company should pay the employee 1426 Dinars and the value of a travel ticket.
The company appealed the ruling before the court of cassation. The company said in its grounds of appeal that the ruling had erred in the application of law. The company said that they had not been informed that the case was referred to the court and therefore they had failed to defend their position.
