BCC 321/2018
This case involved an employee on a fixed term contract who was dismissed before the end of the contract term. A key point was the contract terms should apply until the end of the notice period.
Background
An employee requested the office of labour disputes settlement to order a company to pay her financial entitlements and compensation for unfair dismissal. She said that she had been working for the company under a fixed-term contract and the company dismissed her from the job before the end of the contract term. The case was referred to the court.
The court dismissed the case.
The employee appealed the ruling before the court of cassation. She said in her grounds of appeal that the ruling had erred in the application of law. She said that she should not be deprived of the compensation if she left the job during the notice period. However, she also said that the dismissal was unjustified.
