This case involved whether an employee could be dismissed without compensation and pay in lieu of notice because he had not attended work for ten consecutive days when he had evidence of a medical condition.

Background

An employee filed a case against a company before the court. He requested the court to order the company to pay his financial entitlements and compensation for unjustified dismissal in addition to pay in lieu of notice. He said that the company had dismissed him from his job although he had provided them with medical reports to justify his absence.

The court ruled that the company should only pay the employee's financial entitlements.

The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.
