BCC 1038/2019
This case involved a request for an estate to be valued so it could be divided among the heirs. It was claimed the court had ignored evidence that from bank statements that one of the defendants had transferred part of the estate into their account.
Background
Some claimants filed a case against the defendants before the court. They requested the court to reveal the value of an estate of a deceased woman and divide it among the relevant heirs.
The court defined the value of the estate at 500000 Dinars and said it included several properties.
The claimants appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The claimants appealed the ruling before the court of cassation. They said in their grounds of appeal that the ruling had erred in the application of law and had violated the right of defence. They said that they had maintained before the court that the first defendant had exploited the authorization granted by the deceased woman to transfer part of the estate into her account. They said that they had provided the court with the relevant bank statements but the court had dismissed their defence.
