This case involved whether the centre of commercial arbitration had its own authority and did not come under the Bahraini courts.
Background
A company filed a case against defendants before the court. The company requested the court to dismiss the implementation of an arbitration ruling issued by the Centre of Commercial Arbitration. They said that they were not party in the partnership agreement between the disputed parties.
The court ruled that the arbitration ruling should not be executed.
The first defendant appealed the ruling before the court of appeal. The court of appeal upheld the appealed ruling.
The first defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had violated the law and had insufficient evidence of causation. He said that he had maintained before the court that the consideration of the case did not fall under the jurisdiction of the Bahraini courts according to Article No. 241 of the Advocacy Law.
