This case involved whether an insurance company had the right to replace an individual in a claim against another insurance company after they had paid maintenance costs for a car damaged in an accident.

Background

An Insurance company filed a case against another insurance company before the court. The company requested the court to order the other company to pay amount of money and legal interest of 1%. The company said that they had insured a car and the car was damaged in an accident where the other car was insured by the other company. The company said that they had paid the maintenance costs to the car owner.

The court dismissed the case.

The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The company appealed the ruling before the court of cassation. The company said in its grounds of appeal that the ruling had erred in the application of law. The company said that the court had dismissed the case though they had provided the court with the documents that proved the payment of the maintenance costs.
