BCC 544/2017

This case involved if there was sufficient evidence by relevant witnesses for a request to add a name onto the papers of some claimants.

Background

Some claimants filed a case with the civil court against the defendants requesting that a title be added to their names on their personal papers .

They wished to add a surname to their family they used in order to use the legally entitled right.

The court referred the case to the committee to amend the names and then accepted the claimants requests.

The first defendant appealed the ruling before the Court of Appeal, which upheld the appealed .

The defendant appealed the ruling before the Court of Cassation because it violated the law by upholding the ruling. The defendant said the ruling had ignored the defense of two of the witnesses heard by the committee who did not belong to the family whose title they want to acquire, so the claimants were unable to prove their eligibility by requesting them legally, i.e. to have the affiliation of the three witnesses of the family whose title was to be acquired .
