BCC 521/2017
This case involved a contract to pay for a phone by instalments which had not been paid. It was argued the price was unfair.
Background
A claimant filed a case with the civil court against the defendant, requiring him to pay 1824 Dinars and delay interest .
They had sold him a phone for the mentioned amount, he pledged to pay in instalments, and in writing acknowledged the sale and signed a contract and the purchase invoice, but failed to pay.
The court asked the Consumer Protection Department about the price of the phone, then it asked the defendant to pay 260 dinars, and a 0.05% interest for the claimant.
The claimant appealed the ruling before the Court of Appeal, and ruled to amend the appealed ruling to compel the defendant to pay a 520 Dinars and 1% interest.
