This case involved the statute of limitations on a civil claim against an insurance company for compensation as a result of personal injury caused in a road traffic accident. A key point was that the statute of limitations could not end if the criminal case was ongoing.
Background
Some claimants filed a case with the civil court against the defendant and another party. They requested them to pay a 20200 dinars and compensation for material damage, that resulted from the injury of the first claimant in a traffic accident that had occurred because of the second defendant, when he was driving a car insured against liability arising from accidents with the defendant.
The court dismissed the case because three years had passed since the date the claimants knew about the damage and who was responsible for it. The claimants appealed the ruling before the Court of Appeal, which upheld the ruling.
