BCC 463/2017

This case involved an individual who had been operating a shisha bar without a license and had violated health and safety law. They argued the case had been decided as there had been an earlier case which was dismissed because it was filed against an irrelevant party. This was irrelevant as the violations had not stopped.

Background

The office of public prosecution accused a person of opening a shisha bar without a licence and without meeting the health and safety standards and requested the court to penalize the defendant according to the relevant laws.

The court ruled that the defendant should pay a fine of 50 Dinars.

The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that the criminal case filed against him had already been dismissed because it was filed against an irrelevant party.
