This case involved an individual who had agreed to build a property on some land owned by his mother in return for half the ownership of the property. A key issue was whether a grant of the property to Islamic endowments was valid when she did not own the whole property. However, the mother had previously confirmed she did not have the right to grant the whole property.

Background

Two Claimants filed a case against a defendant before the court. They requested the court to order the defendant to issue an ownership deed for half of a disputed property. They said that they had agreed with the defendant to build a property for their mother and maintain half of the ownership. They said that their mother had granted the property to Islamic endowments without their consent.

The court dismissed the case.

The claimants appealed the ruling before the court of appeal. The court upheld the appealed ruling.
