This case involved a request to confirm a property sales contract. Issues included whether this property had been subject to inheritance or a gift.
Background
A claimant filed a claim before the high civil court requesting confirmation and execution of a sales contract issued by the defendant and others which confirmed that they had sold their share in a piece of land which was the subject matter of the dispute and the other contracts related to the same property. The claimant also asked the real estate property registry to register the land under their name because they had paid the full amount.
The defendants asked that the sale contract not be executed because a gift had been made by the deceased person which nullified it pursuant to a Sharia ruling number 834-2005 and it had become a final ruling.
The court dismissed the case and the claimant appealed the ruling before the court of appeal which cancelled the ruling and confirmed the correctness and execution of the contracts.
