BCC 263/2017

This case involved the liability of an insured person to pay amounts paid in compensation by an insurance company where the son of the insured person who had been driving the car ran away from the scene of the accident and as a result violated the terms of the insurance policy.

Background

An insurance company filed a claim in the form of a payment request to the judge of the Minor Civil Court requesting him to issue an order to the insured person of 1017/500 Dinars plus delay interest in compensation for the amount paid by the company to a person who sustained the damage from a car accident. The accident was caused by the car of the insured person who was insured against civil liability stemming from the accidents. The insured person violated the insurance policy because the driver ran away from the scene following the accident. The case was referred to the High Civil Court in its appeal capacity and the latter upheld the appealed ruling.
