Background
A person filed a claim before the High Civil Court requesting the inventory and distribution of an inheritance. The court agreed to the persons' request and inventoried the inheritance including real estate properties, cars and commercial records as provided for by the wording of the ruling. One of the other heirs appealed the ruling stating that one of the gifted properties could not be recognized as a gift by the deceased person to his grandson because it had not been registered as a gift. The Supreme Court of Appeal ruled that the property should be taken out from the inheritance inventory. The person, who submitted the original claim, appealed the ruling before the court of cassation.
