The initial dispute involved the refusal of a tenant to pay rent. A key issue was the validity of the decision not to accept an appeal because of a lack of reasons.

Background

The owners of a house filed a case before the civil court against the tenant requesting him to pay 4400 Dinars because he had failed to pay the rent for a period of ten months, which he refused to pay in kind

The court dismissed the case by appeal.

The claimant appealed the rule before the Court of Appeal, which ruled not to accept it.

The claimants appealed the ruling before court of cassation because of an error in the application of the law and the ruling that the appeal was not accepted.

They presented a note explaining the reasons in the first hearing.

Decision

The court said that the argument was valid because they had provided the reasons on which they builds their request to amend or annul the ruling.
