The initial dispute involved money which it was claimed was taken from a Waqf and not given to the beneficiaries. There was an appeal that the court had ignored evidence that some beneficiaries had received money. Key issues were whether it was possible to appeal and if lawyers' fees could be awarded when a public body not lawyers had represented them.
Background
An entity filed a case before the High Civil Court requesting the defendants to pay 272500 Dinars. The entity said that the Sunni Sharia Supreme Court had issued a ruling appointing it as a manager of certain Waqf properties along with some of the defendants so they managed and maintained the property and receive the rent and distribute it among the beneficiaries. However, the defendants formed a committee and took over the Waqf property and rented it out and took the rent. The claimed amount was equivalent to the rent which they ha not handed over to the entity to be distributed to the beneficiaries. Therefore the entity filed the claim. The court appointed an expert then ruled that entity was paid the requested amount.
