Background

A company filed a claim against a person in the form of a payment order before the minor civil court requesting they make the person pay 210,952 Dinars plus delay interest for his debts resulting from his use of a telephone service for a certain line. The company provided a statement which showed he did not pay. The judge did not issue the order and dispute was submitted to the subject matter court. The person did not attend the court hearing and court dismissed the claim. The company filed an appeal against the ruling before the High Civil Court. The person did not attend the court and the court upheld the appealed ruling. The company appealed the ruling before the court of cassation.
